Probate

Probate – The Real Story

Probate is the legal process of gathering and distributing your estate.

That being said, Probate, whether by your Last Will and Testament, Muniment of Title, or Administration and Determination of Heirship, is emotional and hard on your family.

If you have a proper Last Will and Testament, you have provided your family with an orderly process.

If you do not have a Last Will and Testament, you maximize the hardship for your family, increase the cost of Probate, and have less certain outcomes.

Texas is a community property state. In order to dispel the myth that you automatically own everything in your spouse’s name when your spouse passes, the truth is that if you have provided for your real property to pass by your Last Will and Testament, you must probate your spouse’s Will.
